Amicus Briefs (Lower Courts)

Multistate coalitions of AGs frequently participate in lower court litigation.

This includes activity not only as direct litigants, but as amicus curiae (“friends of the court”). This activity has increased over time alongside AGs’ overall use of coordinated multistate strategies to influence the direction of policy and law.

Most recent multistate amicus briefs are filed by partisan coalitions of Democratic or Republican AGs. This reflects the highly contested nature of the policy issues involved, such as abortion, immigration, environmental policy, and health care.
